1. Acceptance of Terms

By accessing or using gradely.info, you agree to be bound by these Terms of Service. If you do not agree, please do not use this service.

2. Description of Service

gradely.info provides an online platform for schools to upload student results and for parents to view academic performance securely.

3. School Responsibilities

  • Schools must register truthfully and maintain accurate information.
  • Schools are responsible for the accuracy of uploaded results.
  • Schools must not misuse the system to send spam or unauthorized messages.

4. Parent Access

Parents gain access via credentials provided by the school. You agree to keep your password secure and report any unauthorized access immediately.

5. Data Privacy & Processing Agreement

đŸ‡ŗđŸ‡Ŧ NDPR 2019 Compliant: This section satisfies Article 2.3 of the Nigeria Data Protection Regulation requiring written agreements between Data Controllers (Schools) and Data Processors (Gradely).

5.1 Information We Collect

We collect only what is necessary to provide our services:

  • Student Data: Student ID, name, class/grade, academic results, attendance records
  • Parent/Guardian Data: Name, email address, phone number, relationship to student
  • Authentication Data: Hashed passwords, login timestamps, session tokens
  • Usage Data: Feature access logs, announcement delivery records (anonymized where possible)

5.2 How We Use Your Data

Data is used solely for:

  • Authenticating parent and student access
  • Sending password reset links and notifications
  • Notifying parents when results are ready
  • Providing school subscription management
  • Maintaining security and preventing fraud

5.3 School Responsibilities (Data Controller)

By using Gradely, the School agrees to:

  • Obtain lawful basis for collecting student and parent data under NDPR 2019 (consent, contract, legal obligation, or legitimate interest)
  • Ensure data accuracy and update records when information changes
  • Respond to data subject requests (access, correction, deletion) within required timelines
  • Notify Gradely within 24 hours of becoming aware of any personal data breach
  • Comply with all applicable Nigerian data protection laws, including the NDPR 2019 and Cybercrimes Act 2015
  • Obtain necessary consents from parents/guardians before uploading student data to the platform

5.4 Gradely Responsibilities (Data Processor)

Gradely agrees to:

  • Process personal data only on documented instructions from the School
  • Implement appropriate technical and organizational security measures (encryption at rest and in transit, access controls, regular security audits)
  • Ensure personnel authorized to process personal data are bound by confidentiality obligations
  • Assist the School in responding to data subject requests and regulatory inquiries
  • Notify the School without undue delay upon becoming aware of a personal data breach
  • Delete or return all personal data upon termination of services, unless retention is required by Nigerian law
  • Maintain records of processing activities as required by NDPR Article 2.6

5.5 Third-Party Services (Sub-Processors)

We use trusted services to deliver our platform:

  • Paystack: For school subscription payments
  • Infobip: For SMS notification delivery
  • Resend: For email notification delivery
  • AWS/Render: For cloud hosting and infrastructure

All third parties comply with data protection standards and are bound by written agreements requiring equivalent data protection safeguards.

5.6 Data Security Measures

We implement industry-standard security measures:

  • Encryption: TLS 1.3 for data in transit; bcrypt hashing for passwords
  • Access Controls: Role-based access, secure authentication, principle of least privilege
  • Monitoring: Security monitoring, intrusion detection, regular vulnerability assessments
  • Backups: Encrypted backups with tested restoration procedures

5.7 Data Retention & Deletion

Retention Period: Student data is retained as long as the school remains active on our platform plus 30 days thereafter.

Deletion Process: Schools may request deletion of specific student/parent records via the admin dashboard or by contacting support@gradely.info. Gradely will process deletion requests within 14 days.

Post-Termination: Upon termination of services, Gradely will securely delete all personal data within 30 days, except where retention is required by Nigerian law.

5.8 Data Breach Notification

In the event of a personal data breach:

  1. Gradely will notify the School within 24 hours of becoming aware of the breach
  2. Notification will include: nature of breach, categories of data affected, likely consequences, measures taken
  3. Gradely will assist the School in notifying the Nigeria Data Protection Bureau (NDPB) within 72 hours if required
  4. Gradely will assist the School in notifying affected data subjects where the breach poses high risk to their rights

5.9 Your Rights

You have the right to:

  • Request access to your data
  • Correct inaccurate information
  • Request deletion (via school admin)
  • Object to processing in certain circumstances
  • Lodge a complaint with the Nigeria Data Protection Bureau

6. Prohibited Conduct

You agree not to:

  • Attempt to hack, scrape, or disrupt the service
  • Use automated tools to access the site without permission
  • Impersonate another user or school

7. Announcement Feature Policy

By using Gradely's announcement feature to send messages to students, parents, or staff, you agree to the following:

7.1 Prohibited Content

You shall not send announcements that contain:

  • Harassment, bullying, discrimination, or hate speech
  • Fraudulent, misleading, or deceptive information (e.g., fake exam results, phishing)
  • Illegal content or activities under Nigerian law
  • Spam, unsolicited commercial messages, or excessive promotional content
  • Content that infringes intellectual property rights
  • Personal data of third parties without consent (violating NDPR 2019)

7.2 Moderation & Monitoring

Gradely reserves the right to review, flag, or remove announcements that may violate these terms. All announcements are logged and may be accessed by Gradely staff for moderation, security, or legal compliance purposes.

7.3 Enforcement

Violations may result in:

  • Warning and request to remove content
  • Temporary suspension of announcement privileges
  • Permanent suspension or termination of your school account
  • Reporting to relevant authorities where required by law

7.4 Appeal Process

If your account is suspended for policy violations, you may appeal by contacting support@gradely.info. Appeals will be reviewed within 5 business days, and a written decision will be provided.

7.5 Cost Responsibility

Schools are responsible for all costs associated with SMS/email announcements. Gradely tracks usage for billing transparency and may provide usage reports upon request.

8. Limitation of Liability

While we strive for accuracy, we are not liable for errors in results due to incorrect uploads by schools. We are not liable for indirect damages arising from use of the service.

9. Changes to Terms

We may update these terms at any time. Continued use after changes constitutes acceptance.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms.

11. Governing Law

These terms are governed by the laws of Nigeria. Any disputes will be resolved in Nigerian courts.

Legal Compliance: This policy complies with Nigeria's NDPR 2019, Cybercrimes Act 2015, and applicable consumer protection laws.
